Welcome to LearnX (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our platform and services, including https://lms.wilscons.com/ (the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.

1. Eligibility

1.1 You must be at least 18 years of age to create an account on LearnX. If you are under 18, you must have permission from your parent or legal guardian, and they must review and agree to these Terms on your behalf.
1.2 By using our Platform, you represent and warrant that you meet all eligibility requirements. We may refuse to offer our services to any person or entity at our sole discretion.

2. Accounts and Registration

2.1 Account Creation: To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration.
2.2 Security: You are responsible for safeguarding your account credentials (username, password, etc.). If you suspect any unauthorized use of your account, notify us immediately.
2.3 Multiple Accounts: You may not maintain multiple accounts without our prior written consent.

3. User Conduct

3.1 Prohibited Activities: You agree not to:

• Violate any applicable laws or regulations in Zambia or any other jurisdiction.
• Use the Platform for fraudulent or unauthorized purposes.
• Distribute malicious software or engage in any activity that disrupts the normal flow of the Platform.
• Harass, threaten, or violate the rights of other users.

3.2 Content Standards: Any content you post, share, or otherwise make available through the Platform must:

• Be lawful, truthful, and accurate.
• Not contain hate speech, discriminatory language, or infringe on any third-party rights.

4. Intellectual Property

4.1 Ownership: All content, trademarks, logos, and service marks on the Platform are the property of LearnX or its licensors, unless otherwise noted.
4.2 License to Use: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal or internal business purposes.
4.3 User Content: By posting content on the Platform, you grant LearnX a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute your content in connection with operating and improving the Platform.

5. Payment and Refunds

5.1 Pricing: All fees for courses or other paid services will be displayed before you complete a transaction.
5.2 Payment Methods: We accept various payment methods (e.g., credit cards, mobile money) as indicated on the Platform.
5.3 Refunds: Our refund policy, if any, will be specified during your purchase. If no policy is specified, refunds are not guaranteed.

6. Privacy

Your privacy is important to us. Our practices are outlined in our Privacy Policy. By using the Platform, you agree to the collection, use, and sharing of your information as described in the Privacy Policy, in accordance with Zambian data protection laws and other applicable regulations.

7. Disclaimer of Warranties

7.1 “As Is” and “As Available”: The Platform and its content are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied.
7.2 No Warranty: We do not guarantee that (a) the Platform will be uninterrupted or error-free, (b) the information provided on the Platform is accurate or current, or (c) the Platform will meet your needs or expectations.

8. Limitation of Liability

8.1 No Liability for Indirect Damages: To the fullest extent permitted by law, LearnX and its affiliates will not be liable for any indirect, consequential, or special damages, including loss of profits or data.
8.2 Maximum Liability: In no event shall LearnX’s total liability to you exceed the total amount you paid (if any) for access to the Platform in the six (6) months preceding the event giving rise to the liability.

9. Indemnification

You agree to indemnify and hold harmless LearnX, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms, or your infringement of any intellectual property or other rights.

10. Governing Law and Dispute Resolution

10.1 Governing Law: These Terms are governed by and construed in accordance with the laws of the Republic of Zambia.
10.2 Dispute Resolution: Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Zambian courts.

11. Termination

11.1 Right to Terminate: We may terminate or suspend your access to the Platform at any time, with or without notice, for any violation of these Terms or for any other lawful reason.
11.2 Effects of Termination: Upon termination, any licenses or rights granted to you under these Terms immediately cease. You must stop using the Platform and delete any copies of our materials.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make significant changes, we will notify you via the Platform or by email. Your continued use of the Platform after the revised Terms have been posted indicates your acceptance of the changes.
